Firstly, while the passage of the act you cite is correct, and damning, DSD does have the responsibility to 'provide material, advice and other assistance to Commonwealth and State authorities on matters relating to the security and integrity of information that is processed, stored or communicated by electronic or similar means'.

Part of this responsibility involves testing the security of Ministers' information networks. It is entirely possible that DSD acquired this information during such an investigation. Nevertheless, the results of a security test should not have been read, used, commented on, or passed on to other members of the intelligence community.

Either way you look at this, I think the IGIS will have something to say about it before it is over.
